Question about using texture from commercial games

Look guys, I don't wanna get sued because of 1 unnoticed texture from their game.

 

So here's the question:

-Is it legal if you use them if your WAD is free and you credit them?

It's not actually legal, but so many wad have used textures from Heretic, Descent, and other newer games. You'll be fine as long as you give credit (and don't sell your wad).

It's legal in the same way that posting a screenshot from a movie.  No one cares and no one will stop you but you have maybe done something illegal if you really stretch the definition.

I challenge someone to find a case of someone making a free mod for a videogame, using some assets from another videogame, and not just getting in trouble for it, but having to pay damages or serve a sentence.
