Kizoky Posted November 17, 2021 Remember when Take-Two took down re3 and reVc for allegedly copyright infringement? The developers won't give up.https://torrentfreak.com/gta-modders-to-court-our-game-fixes-enhancements-are-fair-use-211116/ 1 Quote Share this post Link to post
Murdoch Posted November 17, 2021 (edited) Take Two really are just colossal asshats. It is plain they are doing it to try and encourage use of the new updated version. I don't think really fair use applies here and it's not quite the right concept for a fix that still require the purchase of the original work to actually be usable. I think the point the modder lawyers will focus on is that it doesn't detract from the value of the original releases, but Take Two's lawyers will focus - in probably a very round about way - on it potentially affecting sales of the re-release. And that's arguably true. But the bigger detriment to the sales for the re-release is it's fucking shite so... I don't know which a judge is more likely to give the most weight to. It would be interesting to hear someone who actually knows copyright law discuss this like Leonard French. Edited November 18, 2021 by Murdoch 4 Quote Share this post Link to post
scalliano Posted November 17, 2021 As much as I agree with the re3/VC devs on this one, T2 have bottomless funds when it comes to lawyers and have a rep for stringing out a court case until the other side can't afford to continue. Anybody who wants the executables can PM me. Fuck it. 4 Quote Share this post Link to post

The latest existing forks I can find date to about September 2nd, but the DMCA re-takedown apparently only happened around September 30th. 0 Quote Share this post Link to post
scalliano Posted November 18, 2021 Grabbed them on 11th September - note that I only grabbed the 64bit ones. 0 Quote Share this post Link to post
Redneckerz Posted November 18, 2021 T2 obviously is yet to understand that what existed on the internet, will remain on the internet. DMCA Takedown is hardly that effective, unless your China and you have something like Weibo. Given that the Western World does not have that, T2 can DMCA all they want, somewhere those builds will be hosted and posted. And i mean, weren't they reverse engineered? Was it not a clean room implementation? Than those forks are completely fair: If the code performs similar but is different that would form some legality. 0 Quote Share this post Link to post

Biodegradable Posted November 19, 2021 I thought these morons loved money? I mean, if you're completely fine with farting out broken games with absolutely no intention of listening to criticism and fixing them, wouldn't it make sense to let the customer fix them of their own accord (for fucking free by the way) by creating mods, thus only adding to the influx of people who would pay for the game in the first place? After all, Take-Two made sure that going back to the old games isn't an option since they've been removed from digital storefronts. So, there's the incentive for people to buy the sodding remaster in the first place because there is no other choice. The publisher would still be raking in the dough regardless. If they actually cared about quality, mainstream gaming wouldn't have completely normalised their habit of publishing unfinished piles of digital slag and slapping a $70 price tag on them. You've got to love how these idiotic publishers-who are a part of one of the richest industries in the world today-are so cheap that they'd rather cut corners than deliver a quality product, then get all pissy and litigious because some enterprising people had the gall to give a shit and put in the effort they skimped on. 0 Quote Share this post Link to post
